Terms & Conditions

1. Overview

These Terms and Conditions govern the purchase and use of the Local Continuity System (“LCS”) software and associated documentation, a product of Be Prepared Education LLC (“Company”, “we”, “us”). By purchasing or using LCS, you agree to these terms.

2. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, perpetual license to deploy and use LCS within your organization subject to the following conditions:

Scope: The number of concurrent instances depends on your edition: Core (1), Pro (2), or Team (5). Each edition permits unlimited cold spares (inactive instances ready for failover). The license is per-organization, not per-device. Any device on the local network may access the system.

Modification: You may modify configuration files and make internal customizations for your organization's use. Redistribution of modified or unmodified versions is prohibited.

Updates: All patch and minor updates within the 1.x version branch are included at no additional cost. Major version upgrades (e.g., v2.0) may require a separate purchase, with discounted upgrade pricing available to existing license holders.

3. Intellectual Property

LCS, including all software code, documentation, scripts, templates, and design elements, is the intellectual property of Be Prepared Education LLC. Your license grants usage rights only; it does not transfer ownership of any intellectual property.

4. Payment & Delivery

All purchases are processed through Stripe. Pricing is listed in U.S. dollars. Applicable sales tax is calculated and collected at checkout via Stripe Tax. Upon successful payment, you will receive an email containing download links for your edition's ZIP archive.

5. Refund Policy

Due to the digital nature of this product, all sales are final. If you experience a technical issue that prevents you from using the product as described, contact us at support@bepreparededu.com within 14 days of purchase and we will work to resolve the issue or provide a refund at our discretion.

6. Disclaimer of Warranties

LCS is provided “as is” without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted, or suitable for any particular purpose. The documentation describes the system's intended behavior and capabilities but does not constitute a guarantee of performance.

7. Limitation of Liability

To the maximum extent permitted by law, Be Prepared Education LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use LCS, regardless of the theory of liability.

8. No Support Obligation

LCS is a self-deployable system. The documentation is the support. There is no helpdesk, no managed service, and no service-level agreement. We may provide community resources or supplementary guidance at our discretion, but are under no obligation to do so.

9. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, United States of America.
